Pine Labs Private Limited ("Pine Labs") has been granted an authorization to issue prepaid payment instruments by the Reserve Bank of India ("RBI"). Pine Labs has collaborated with Rupay network operated by National Payments Corporation of India for issuance of the Bharat Yatra MTS PPI card (“Bharat Yatra Rupay Card”) . This Card is a prepaid Rupaycard which can be used for enabling payments at the Transit operators in India wherever National Common Mobility Card (“NCMC”) balances are accepted.
Cardholder shall be referred to as "User". The User hereby consents to Pine Labs sharing transactional and personal information with its Pine Labs third-party service providers only for customer service and additional services.
1. All Cards shall be valid for period of 5 (Five) years and shall remain valid till the date mentioned on the face of the Card. The validity of the Card may be extended by Pine Labs, or a replacement card may be issued on expiry, upon request from the Purchaser or the Cardholder subject to applicable fees and at the sole discretion of Pine Labs.
2. The Cardholder can use the Bharat Yatra Rupay card for the purpose of making payments at transit operators within India. The facility to withdrawal cash shall not be available on the Card. No interest shall be payable by Pine Labs on the amount available / loaded on the Prepaid Card.
3. The maximum NCMC balance that can be loaded/reloaded onto the on the Bharat Yatra Rupay Card is Rs 2000 (“NCMC Balance”) .
4. The User may load and reload cash onto the Card using the Bharat Yatra mobile App (“Bharat Yatra App”) or at selected transit operator's locations subject to verification of their identity of the User and any other mandatory requirements as prescribed by the RBI from time to time. Limitations regarding minimum amount, maximum amount, annual load limit and frequency of loading and reloading shall be applicable as prescribed by Pine Labs from time to time. The cash loading / reloading facility is subject to the relevant applicable fee(s) and may be loaded/reloaded by the User while visiting selected service outlets.
5. Incase the Card is lost or stolen, the cardholder must immediately report such loss/ theft over the telephone to the Customer Care for blocking the NCMC Balance. On receipt of any such intimation Pine Labs shall, upon adequate verification of the Cardholder, hotlist/ cancel/ suspend/ block the Card and terminate all facilities in relation thereto and Pine Labs shall not be liable for any inconvenience caused to the Cardholder in this regard. The Cardholder will be liable for all charges from the NCMC balance incurred on the Card until it is reported lost/ stolen. Pine Labs shall not be liable for any loss of NCMC balnce on the lost NCMC card as the same is not transferable. Balance before, prior to hotlisting/ canceling/ suspension/ blocking of the Card.
6. The Card cannot be resold, transferred for value or redeemed/exchanged for its value in cash by the Cardholder. Cash withdrawal facility is not available on the Card.
7. This card will only be issued by Pine Labs on request of the Cardholder and is distributed to the Cardholder on agreeing to these Terms and Conditions (as updated from time to time)
8. The Cardholder hereby acknowledges and agrees that if there are no Transaction for a consecutive period of one (1) year on the Card, subject to validity of the Card, the Card shall be made inactive by Pine Labs byLabs by sending a notice to the Cardholder on the registered mobile number.
9. The limit for contactless transactions will be as prescribed by RBI.
10. The Cardholder shall indemnify, defend and hold harmless Pine Labs from and against any and all third party liability, losses, costs and expenses (including reasonable attorneys’ fees) relating to or arising out of the breach of these terms and conditions, the negligence or wilful misconduct or fraud by the Purchaser, or its employees or agents.
11. PINE LABS DOES NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A CARD IS NON-FUNCTIONAL, THE PURCHASER AND THE CARDHOLDER’S SOLE REMEDY WILL BE THE REPLACEMENT OF SUCH CARD .
12. The Cardholder shall inform [*], by contacting the Customer Care at XXXXXXX or email at XXXXXXXXXXX, within 10 (Ten) days of occurrence of any transaction, if any irregularities or discrepancies exist in such transaction or if such Cardholder has any query or complaint in relation to the Transaction including for any unauthorised transaction. If [*] does not receive any information to the contrary within 10 (Ten) days of occurrence of any Transaction, it shall be entitled to assume and proceed on the basis that the relevant Transaction(s) was effected without any irregularity/ discrepancy. Subject to the foregoing, all transactions as aforesaid shall be dealt with in accordance with the Customer Grievance Redressal Policy of Pine Labs. These cards will be distributed by authorised [*] personnel only.
13. All fees, surcharges, goods and applicable taxes with respect to Card shall be borne by the Purchaser or the Cardholder. Pine Labs shall have no liability towards the same. There may be surcharge applicable on certain card transactions. In such an event, the same will be deducted from the card balance available in the Card at the time of transaction. In case the card balance is not sufficient to provide for the surcharge the transaction shall be declined.
14. In case of no financial transaction for a consecutive period of one year then Card shall be made inactive after sending a notice to the Cardholder. These can be reactivated only after validation and due diligence.
15. Cardholders can check the available balance of cards by logging in on the BharatYatraMobile App.
16. Any dispute in relation to the Cards shall be referred to [*] and the decision of Pine Labs shall be final in this regard. Any disputes and claims in relation to the card shall be subject to the laws of India and the jurisdiction of the courts at New Delhi.
